  2. LICENSE AGREEMENT

  4. By downloading the software/contentware, opening the media package, 
  5. installing the textures/manual on your computer, you agree to be 
  6. bound by all the terms and conditions of this agreement. 
  7. If you do not agree with these terms, you must promptly destroy 
  8. all copies of the software/contentware and accompanying documentation.
  9.  
  10. We grants you a non-exclusive and non-transferable license 
  11. to use one (1) copy of the executable code of the software/contentware 
  12. and accompanying materials according to the following terms:

  14. You may
  15. 1. use the software/contentware on any single computer residing in your premises
  16. 2. use the software/contentware on different computers, as long as there is no 
  17. possibility that it is used at more than one location at the 
  18. same time or on a computer network by more than one user 
  19. at the same time.
  20. 3. copy the software/contentware for back-up purposes provided any copy must 
  21. contain all of the original software/contentware's proprietary notices and 
  22. provided your backup copy is not installed or used on any computer.

  24. You may not
  25. 1. permit other individuals to use the software/contentware except under the terms 
  26. listed above
  27. 2. modify, adapt, translate, reverse engineer, decompile, disassemble 
  28. or create derivative works based upon the software/contentware (other than by adding 
  29. a 'reasonable' level of additional artistic content - please contact us on that)
  30. 3. copy the software/contentware, except for backup purposes
  31. 4. sell, resell, rent, lease, sublicense, assign, or otherwise transfer 
  32. rights to the software/contentware
  33. 5. remove any proprietary notices or labels on the software/contentware.

  36. NO WARRANTIES

  38. This software/contentware is provided as is, without warranty of any kind. 
  39. We and our suppliers disclaim all warranties, either express 
  40. or implied, including, but not limited to, 
  41. implied warranties of merchantability and fitness for a particular purpose, 
  42. with regard to the innovations and any other software/contentware included in 
  43. the distribution package or archive.

  46. NO LIABILITIES FOR CONSEQUENTIAL DAMAGES

  48. To the maximum amount permitted by applicable law, in no event shall 
  49. we or our suppliers be liable for any damages whatsoever (including, 
  50. without limitation, damages for loss of business profits, business 
  51. interruption, loss of business information, or any other loss) arising 
  52. out of the use of or inability to use this Innovations product, even if 
  53. we have been advised of the possibility of such damages.  
  54. Because some states/jurisdictions do not allow for the exclusion or 
  55. limitation of liability for consequential or incidental damages, the 
  56. above limitation may not apply to you.
